Our client was a forklift operator, who was unloading a shipping crate along with a co-worker. The forklifts were fueled by propane tanks. Unbeknownst to our client, his propane tank was leaking fuel. Because propane is heavier than air, as it leaked it settled onto the floor of the shipping crate. When our client lowered the forks, the resulting friction generated a spark. Which caused an explosion.

We demonstrated the propane tank was defective. Specifically, it had a faulty o-ring – – and thus was not sealed – – which the manufacturer should have known of, and was solely responsible for.

Our client had burns over a significant percentage of his body, and also brain damage. The defendants settled for $9 million.
